1. The promoter is Fletcher Insulation Pty Limited ( ACN            001 175 355 ) of level 4, 68 Waterloo Road, Macquarie Park NSW 2113 (Promoter).
    2. The Promoter has appointed Hachiko Pty Ltd of 201/117 Old Pittwater Road, Brookvale NSW 2100 as an independent scrutineer to administer the Promotion (Administrator).
    3. Participation in the Promotion is deemed acceptance of these terms and conditions (Terms). Information on how to enter the Promotion forms part of the Terms.
    4. The Promoter’s decision in relation to any aspect of these Terms and the Promotion is final and binding on every person who enters (including those entries that are deemed ineligible for any reason). No correspondence will be entered into.
    1. The Promotion commences at 12.01am on 1 March 2017 and conclude at 11.59pm AEST on 30 April 2017 (Promotion Period).
    2. Entry in the Promotion is only open to customers of the Promoter who are permanent Australian residents over 18 years old, who purchase one or more Pink Batts® and/or Sisalation® products from the Promoter during the Promotional Period in Victoria, Tasmania, New South Wales, Queensland, South Australia, Western Australia, Australian Capital Territory and Northern Territory (Eligible Entrant).
    3. To enter the Promotion, Eligible Entrants must submit an entry form (either online at insulation.com.au/promotion or via Post) and retain the original purchase receipt as proof of purchase. Eligible Entrants may submit a limit of one entry per receipt per day. Multiple entries for the same receipt will disqualify all entries (regardless of whether multiple Pink Batts® or Sisalation® products are included on the receipt). Each entry must be submitted separately.
    4. Entries must be received by the Promoter during the Promotion Period. Entries received before or after the Promotion Period will be ineligible. The Promoter is not responsible for any entries that are not received during the Promotion Period and the Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.
    5. Eligible Entrants must retain their original receipt corresponding to each entry they submit in the Promotion in order to claim the Prize (if won).
    6. The following persons are not eligible to participate in the Promotion or receive the Prize:
      1. employees of the Promoter or Administrator or their respective related entities;
      2. immediate family of a person referred to in paragraph 2.4(b) above; and
      3. any person or persons deemed ineligible by the Promoter or Administrator in their absolute discretion.
    7. Incomplete, indecipherable or incorrect entries are not eligible for the Promotion.
    1. The total prize for this Promotion is for a one-off prize of AUD$20,000.00 (GST inclusive) (Prize).
    2. The draw for the Prize will be conducted by the Administrator at 201/117 Old Pittwater Road, Brookvale NSW 2100, at 12.00pm AEST on Monday 22nd May 2017 (“Draw”). Subject to these Terms, the first valid entry drawn by the Administrator will win the Prize (Winner). The Prize will be awarded via direct bank transfer to the winners nominated bank account or via cheque, at the Promoter’s discretion. The Prize must be taken as offered and cannot be transferred, exchanged or varied by the winner.
    3. The Winner will be notified in writing within two (2) business days of the draw and the Winner’s name and postcode will be published in “The Australian” newspaper on Wednesday, 24th May 2017. The Promoter is not responsible for any undelivered email or other correspondence.
    4. If the Winner is deemed ineligible for any reason or is not contactable, or the Prize remains unclaimed by 12.00pm AEST on 31st August 2017 then a redraw will be conducted by the Administrator from the remaining eligible entries (Redraw). The Redraw will take place on 1st September 2017 at the same time and place as the original Draw, subject to any direction or qualification from a regulatory authority. The winner of the Redraw will be notified in writing within two (2) business days of the Redraw and the winner’s name and postcode will be published in “The Australian” newspaper on Wednesday, 13th September 2017.
    5. The redraw Winner must redeem the Prize by 13th December 2017.
    1. The Promoter reserves the right, at any time, to verify the validity of entries, proof of purchase and entrants (including an entrant’s identity, age, place of residence and original proof of purchase) and disqualify any entrant or entry that is not in accordance with these Terms. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    2. The Promoter may disqualify the Winner if they fail to produce photo identification or original receipt(s) that correspond(s) to all entries they have submitted in the Promotion, within the time required by the Promoter. If the Winner is unable to produce the items to Promoter’s reasonable satisfaction or within the time period required by the Promoter, the Winner will be disqualified and a Redraw will be conducted.
    3. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
      1. to disqualify any entrant; or
      2. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
    4. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties including but not limited to agents, employees and service providers assisting with this Promotion. Entry is conditional on providing this information. By entering the Promotion, you consent to the Promoter using, unless otherwise advised, the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant in accordance with the Promoter’s privacy policy at insulation.com.au. The Promoter will keep your personal information for only as long as is necessary to carry out the purpose(s) described above (unless it is required or permitted by law to hold the information for a longer period). Entrants should direct any request to access, update, correct information or opt out to the Promoter.
    5. All entries become the property of the Promoter.
    6. As a condition of entering the Promotion, the Winner (and winner of any Redraw) consents to the Promoter using his/her name, likeness, image and/or voice in any media (including photograph, film and/or recording of the same) when advertising its business or the Promotion for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
    7. As a condition of entering the Promotion, the Winner (and winner of any Redraw) must sign any documentation and in the form required by the Promoter, including but not limited to a release and indemnity form.
    1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters’ ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in their absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to state government legislation.
    2. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Promotion and the Australian Consumer Law, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
    3. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Administrator (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, in connection with or arising in any way out of the Promotion, including but not limited to the following:
      1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
      2. any theft, unauthorised access or third party interference;
      3. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
      4. any tax liability incurred; or
      5. the use or enjoyment of the Prize.
